When a 50-year-old restaurant worker was involved in a crash with a truck on Virginia’s Eastern Shore she suffered numerous injuries. But it was an infection following surgery that claimed her life.

Now her widower from Accomack County, VA has reached a $500,000 out-of-court settlement with a Maryland (MD) based business whose truck was involved in the 2008 crash at Chincoteague.

Terri Borgstrom died from a bacteria infection after surgery following numerous fractures, Eastern Shore News reported.

The truck was owned by Tri-Gas and Oil Company of Maryland. No charges were brought because both drivers in the collision claimed they had a green light.

As experienced attorneys covering truck accidents on the Eastern Shore of Virginia (VA), our thoughts are with the family of the victim. This settlement demonstrates that just because nobody was charged after this accident, it doesn’t preclude a lawsuit. The payout was a result of good work by lawyers Lawrence Land and Ed Fiorella.

And it again highlights how a trucking company is responsible for the actions or inactions of its drivers.

In the recent case of a City of Chicago sanitation truck driver who was charged with DUI after ploughing into a crowd of people in 2011, lawsuits were brought against the city.

But the trucking company is not the only party that could have been sued in this case. The medical authorities could have faced a wrongful death lawsuit over medical malpractice because Mrs. Borgstrom died a bacteria infection following surgery.

As hospitals have seen a spike in infections in recent years MRSA lawsuits have become more common. In this case claims against medical providers were not pursued.
